· A 10% buyer’s premium will be added to the winning bid to determine the final sale price.
· A $10,000 deposit is due from the winning bidder with the balance due within 30 days. The deposit will be placed in the Hodges Auction escrow account and applied to the purchase at closing. Buyer is responsible for their own title opinion and arrangement of closing. If title is uninsurable, the seller has 45 days to correct any defect(s), or the escrow deposit may be returned to buyer.
· Property taxes will be prorated to the date of deed.
· Possession will be given with delivery of the deed.
· Property is available for inspection by appointment prior to the auction.
· In the event of a tie max bid, precedence will be given to the bid placed first.

· Seller agrees to maintain the property in its current condition, normal wear and tear excepted, until the closing. Also, the Seller agrees and understands that she, as the Executor to the Estate, is only selling the property in “as is” condition, and Seller waives all warranties, express or implied, and any claims based upon warranty, and Seller can fill out a Seller’s Disclosure Statement but only agrees to put on that statement that Seller has no knowledge of the condition of the property. All parties agree and understand the Seller is the estate and did not live at the property and therefore has no knowledge of the condition of the home and therefore all parties understand that any comments made about the home do not in any way, either expressly or implicitly, create any type of warranty as to the condition of the house and land.
· Special Warranty: Executor/Executrix warrants title to the property in her fiduciary capacity only to the extent of the assets of said estate in the hands of the Executor/Executrix at the time of the notice to her of a breach of any of the foregoing warranties and covenants of title.
